Complaints and dispute procedure

The Complaints and Disputes Procedure for the Legal Profession applies to our services. If you are dissatisfied with the quality of our services or the amount of the invoice, you will first have to present your objections to your own lawyer. If you are unable to resolve the matter, you can contact the Vissers Advocatuur complaints officer, Mrs. Gemmy Van der Valk – Van den Bosch.

Our complaints procedure serves as a guideline in handling your complaint. These complaints regulations and the name of the complaints officer are available on request. You must submit your complaint within three months after the moment you became aware or reasonably could have become aware of the act or omission that gave rise to your complaint.

If, in your opinion, our firm has not resolved your complaint satisfactorily, you may submit a complaint to the Disputes Committee for the Legal Profession (Geschillencommissie Advocatuur). The Disputes Committee for the Legal Profession handles the case according to the Legal Profession Disputes Committee Rules that apply at the time when the complaint is submitted to that committee. You can request the regulations from the Disputes Committee for the Legal Profession at the address: PO Box 90600, 2509 LP The Hague. You may submit your complaint to the Disputes Committee for the Legal Profession at the above address no later than twelve months after the written response from our firm.

The Disputes Committee for the Legal Profession rules in the form of an arbitral award for business clients or in the form of a binding opinion in the event that the dispute is brought by a private client. The Disputes Committee for the Legal Profession is authorized to rule on complaints regarding the quality of the services provided by the lawyer and the amount of the invoice. You may also find that you are entitled to compensation. The Disputes Committee for the Legal Profession is also competent to adjudicate on claims for damages up to a maximum of € 10,000. Higher damage claims can only be submitted to the Disputes Committee on the Legal Profession if the amount of the claim is explicitly limited to a maximum of € 10,000 and if the excess is waived in writing.

Our firm can submit unpaid invoices for collection to the Disputes Committee for the Legal Profession.

No appeal is possible against the decision of the Disputes Committee.

 

Law firm registration

Based on this registration, they are required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands Bar.
